EXAMPLE CASE RESULTS

 

1. Client charged with five (5) counts of Aggravated Assault with a Deadly Weapon. The defendant allegedly drove into a trailer park to solicit an underage prostitute.  Members of the community called the police and the defendant allegedly ran over 5 people while leaving to elude law enforcement.   At trial, Attorney Eric Evilsizer was able to show that all of the alleged victims were family members and had fabricated the story in order to obtain an insurance settlement.

RESULT – Not Guilty at Trial on all 5 counts.

2. Defendant was charged with Driving Under the Influence ("DUI") and the defendant refused to submit to a breathalyzer. At trial, Attorney Eric Evilsizer successfully argued that the field sobriety exercises offered by the arresting officer, and the driving pattern offered by witnesses did not prove the defendant was guilty.

RESULT - Not Guilty at Trial.

3. Defendant was charged with Battery.  The alleged victim was a child.  At trial, Attorney Eric Evilsizer was able to show that law enforcement had not done an adequate job of investigating.  Mr. Evilsizer found two adult witnesses who saw that the defendant was trying to break up a fight among some of the children, whose parents were not present. 

RESULT - Not Guilty at Trial.

4. Defendant was charged with Careless Driving, a civil infraction.   At hearing, Attorney Eric Evilsizer successfully argued that the officer who wrote the ticket lacked probable cause to believe that the defendant was the driver of the vehicle.

RESULT – Infraction Dismissed.
